Terms of Service

These Terms of Service ("Terms") govern access to and use of Pozool websites, products, applications, tools, and related services (collectively, the "Service"). By accessing or using the Service, creating an account, requesting a demo, or entering into an order, statement of work, subscription, or similar agreement with Pozool, you agree to these Terms.

1. The Service

Pozool provides property management software and related operational tools for rental operators, including reservations, calendars, payment tracking, guest communication, reporting, and operational workflows. Features may change, be added, or be removed over time.

2. Eligibility and Accounts

You must have authority to bind the business or organization you represent. You are responsible for all activity under your account, including activity by employees, contractors, administrators, invited users, and anyone using your credentials. You must keep login credentials confidential and promptly notify us of suspected unauthorized access.

3. Customer Responsibilities

You are responsible for:

  • Providing accurate account, billing, property, reservation, guest, and operational information.
  • Obtaining rights, permissions, notices, and consents required to use data in Pozool.
  • Ensuring your properties, listings, pricing, taxes, fees, rules, messages, and guest-facing content comply with applicable laws and platform rules.
  • Managing user permissions, reviewing automated outputs, and verifying operational tasks before relying on them.
  • Maintaining appropriate insurance, licenses, permits, tax registrations, and property compliance.

4. Third-Party Channels and Providers

The Service may connect with third-party booking channels, payment processors, messaging providers, analytics providers, hosting providers, or other tools. Third-party services are not controlled by Pozool. We are not responsible for their availability, accuracy, security, fees, rules, policy changes, account restrictions, lost reservations, delayed messages, payment failures, or other actions or omissions. Your use of third-party services is governed by their own terms.

5. Payments, Fees, and Taxes

Fees, billing cycles, payment methods, and plan details are set out in the applicable order, invoice, written agreement, or product checkout flow. Unless we expressly state otherwise in writing, fees are non-refundable and are exclusive of taxes, duties, currency conversion costs, bank charges, and third-party fees. You authorize us and our payment processors to charge your payment method for amounts due. You are responsible for taxes related to your use of the Service and your rental operations.

6. Late Payment and Suspension

If payment is late, declined, disputed, reversed, or otherwise not received, we may suspend or limit access to the Service, stop work, withhold support, charge late fees or collection costs where allowed by law, and terminate the account. Suspension does not relieve you of payment obligations.

7. Acceptable Use

You may not:

  • Use the Service for illegal, deceptive, abusive, harmful, or discriminatory activity.
  • Interfere with, reverse engineer, scrape, overload, or compromise the Service.
  • Upload malware, unauthorized personal data, infringing content, or content you do not have rights to use.
  • Misrepresent reservations, payments, property availability, guest communications, or operational status.
  • Use the Service to violate third-party platform rules or applicable laws.

8. Customer Content and Data

You retain ownership of content and data you submit to the Service. You grant Pozool a limited license to host, copy, process, transmit, display, and use that content and data as needed to provide, secure, support, and improve the Service, comply with law, and enforce these Terms.

9. Pozool Intellectual Property

Pozool and its licensors own the Service, software, designs, workflows, documentation, branding, and related intellectual property. These Terms do not transfer ownership to you. You may use the Service only as permitted by these Terms and any applicable agreement.

10. Beta Features and Product Changes

We may offer beta, trial, preview, or experimental features. These are provided for evaluation, may be changed or discontinued at any time, and may be less reliable than generally available features.

11. Support

We may provide support through the channels and during the hours we make available. We do not guarantee any specific response time or resolution unless expressly agreed in writing.

12. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Pozool disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and error-free operation. Pozool does not guarantee that the Service will prevent losses, increase revenue, ensure legal compliance, avoid double bookings, detect every payment issue, or replace professional judgment.

13. Limitation of Liability

To the maximum extent permitted by law, Pozool will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, revenue, goodwill, reservations, platform accounts, or business interruption. Pozool’s total liability for all claims relating to the Service will not exceed the amount you paid to Pozool for the Service in the three months before the event giving rise to the claim, or USD $100 if no amounts were paid.

14. Indemnification

You agree to defend, indemnify, and hold harmless Pozool, its owners, team members, contractors, and service providers from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from your use of the Service, your properties or rental operations, your content or data, your breach of these Terms, your violation of law, or disputes with guests, owners, employees, contractors, service providers, booking channels, or payment processors.

15. Termination

You may stop using the Service at any time, subject to any payment commitments in your agreement with us. We may suspend or terminate access if you breach these Terms, fail to pay, create risk for Pozool or others, misuse the Service, or if we discontinue the Service. Sections intended to survive termination will survive, including payment, intellectual property, disclaimers, limitation of liability, indemnification, and dispute terms.

16. Privacy

Our Privacy Policy explains how we collect and use information. By using the Service, you agree to the Privacy Policy.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, unless another governing law is stated in a written agreement signed by Pozool. Courts located in Florida will have exclusive jurisdiction, except that Pozool may seek injunctive or equitable relief in any appropriate court.

18. Changes to These Terms

We may update these Terms from time to time. Updates are effective when posted unless a different date is stated. Continued use of the Service after an update means you accept the updated Terms.
